1. Acceptance of These Terms

By visiting this site, submitting an inquiry, or engaging Ya O Nunca Marketing for services, you agree to these Terms & Conditions. If you don't agree, please don't use our services.

2. About Ya O Nunca Marketing

Ya O Nunca Marketing ("YoN Marketing," "we," "us") is a sole proprietorship operated under Mexican law, headquartered in Mexico and serving clients in Mexico, the United States, and internationally. Contact: team@yaonuncamx.com.

3. Services We Offer

We provide marketing services — social media management, brand identity, web design, SEO & local presence, strategy & consulting, email marketing & CRM, influencer & UGC, and AI & automation — delivered through defined engagement tiers (Básico, Profesional, Premium, Platino) or standalone project tracks (content/social or technical build). We also offer hourly virtual assistant services, described separately at yaonuncamx.com/va.html.

4. Engagement, Pricing & Payment

Pricing shown on this site is starting-at pricing; final scope and cost are confirmed during your free consult and documented in your individual service agreement before work begins. Our tiered engagements (Profesional and above) carry a 6-month minimum commitment — that's the timeframe we've found it takes for marketing work to compound into visible results. Retainer engagements are billed monthly. Virtual assistant services are billed hourly. Invoices are due on the terms stated in your agreement; we reserve the right to pause work on overdue accounts.

5. Cancellation & Refunds

• Retainer engagements (Básico / Profesional / Premium / Platino): cancellation terms, including any notice period, are set out in your individual service agreement, agreed before work begins.
• Virtual assistant services: hours billed are final once the work has been delivered. If you need to cancel an upcoming block of hours, let us know as early as possible.
• One-off projects and starter packages (e.g. workspace setup, logo design kits): final once delivered, same as any custom project work.

We're a small, real business — if something goes wrong, talk to us. We'd rather fix it than fight about it.

6. Intellectual Property

Once you've paid in full for a project or deliverable, you own it. Until then, all work product remains our property. We retain the right to showcase completed work in our portfolio, case studies, and marketing materials unless we've agreed otherwise with you in writing.

7. Client Responsibilities

Good work depends on good input. You agree to provide timely feedback, requested materials (brand assets, access credentials, approvals), and accurate information about your business. Delays on your end may affect our delivery timeline.

8. Limitation of Liability

We provide our services with care and professional skill, but we don't guarantee specific business outcomes — traffic, leads, sales, or rankings depend on many factors outside our control. To the extent permitted by law, our liability for any claim related to our services is limited to the fees you've paid us for the specific service giving rise to the claim.

9. Confidentiality

We treat information you share with us about your business as confidential, and we ask the same of you regarding our internal processes and pricing. This obligation survives the end of our engagement.

10. Governing Law

These Terms are governed by the laws of Mexico. Any dispute arising from these Terms or our services will be resolved under Mexican jurisdiction, without prejudice to any consumer protections you're entitled to under your local law.

11. Changes to These Terms

We may update these Terms from time to time. The effective date above reflects the most recent revision. Continued use of our services after a change means you accept the updated Terms.
